Abstract:

This subject is designed to provide students with an understanding of the collective aspects of industrial law in Australia. An examination will be made of the sources of industrial law, the constitutional basis of industrial law, the contents of a Federal Award, industrial organisations and industrial action, common law and legislative controls over industrial organisations and secondary boycott legislation. This subject also examines the wage fixation principles currently in place and enterprise bargaining.

Objectives:

Upon successful completion of this subject, students should:

- understand the constitutional basis of industrial law;
- understand the collective aspects of industrial law in Australia;
- understand what is an industry? What is an industrial dispute?
- understand what can be in a Federal Award and enterprise agreement;
- understand how registered organisations are controlled both by the common law and by Federal legislation;
- understand the nature of controls placed on industrial organisations and industrial action;
- understand the legal basis for wages and conditions of employment in Australia.

Syllabus:

The subject will cover the following topics:

- Introduction to industrial law; - The constitutional basis of industrial law; - What is an industry? What is an industrial dispute? - The contents of Federal Awards. - Industrial organisations. - Industrial action. - Awards, certified agreements, Australian Workplace Agreements and wage fixation.
