LAW111 Mental Health Law and Policy (8)

Abstract

This subject examines mental health law and policy in Australia, including issues such as: care and treatment of vulnerable people, criminal and forensic aspects, human rights and guardianship. The subject concludes with a an overview of future trends in mental health law and policy.

Learning Outcomes

Upon successful completion of this subject, students should:
-be able to demonstrate understanding and knowledge of
values and ideologies which underpin law within social services such as mental health services:
-be able to demonstrate understanding and knowledge of
the history of the development of mental health law.
-be able to demonstrate understanding and knowledge of
the relationship between law, psychiatry, the State and human rights;
-be able to demonstrate understanding and knowledge of
public policy initiatives in relation to mental health services in Australia;
-be able to demonstrate understanding and knowledge of
social policy issues and concerns in the provision of mental health services;
-be able to demonstrate understanding and knowledge of
aspects of the law of mental health which especially affect the liberty and treatment of the mentally ill or mentally disordered person,
-be able to demonstrate understanding and knowledge of present directions and reform initiatives in mental health law and
policy.

Syllabus

The subject will cover the following topics:
1 A history of the development of mental health services 2 Law and policy in social services 3 Law. psychiatry and the State 4 Contemporary trends in mental health law and policy 5 Contemporary policy developments in mental health 6 Social policy issues and vulnerable community groups 7 The Mental Health Act 1990 (NSW) and mental illness 8 Admission to and care of mentally ill persons in hospitals 9 Care and treatment of mentally ill persons outside hospitals 10 Treatments for mentally ill patients in hospitals 11 Forensic patients Mental illness and criminal procedure 12 Mental illness and guardianship law. 13 Perspectives and future directions in mental health law and policy.
