LAW200 Commercial Activities: Law & Policy (8)

Abstract

This subject explores the legal environment for conducting business. It examines business relationships (licensing, franchising, agency), financial transactions (negotiable instruments, cheques and banking), and risk management (insurance, bankruptcy) as well as property issues.

Learning Outcomes

Upon successful completion of this subject, students should:
- be able to apply the principles of property law; including real, personal and intellectual property;
- be able to outline and describe the principles of agency and explain how they are applied in business settings;
- be able to explain the differences between agency, distributors, franchising and licensing;
- be able to outline and describe the principles and processes of bankruptcy law, to explain what property is available for distribution to creditors, and the alternatives to bankruptcy available under the Bankruptcy Act 1996 (Cth);
- be able to explain the principles governing protection against loss through insurance;
- be able to explain the uses of negotiable instruments, the banker-customer relationship and the law of cheques.

Syllabus

The subject will cover the following topics:
Commercial Rights and Responsibilities including Customs, Practices and Legal Regulation. Business Relationships including Licensing, Franchise, Distributorship and Agency. Financial Transactions including Cheques, Banking and Electronic Funds Transfer. Property Dealings including Real, Personal and Intellectual Property. Risk Management including Insurance and Bankruptcy.
