LAW291 Environmental Law and Administration (8)

Abstract

This unit equips students to be effective users of relevant environmental and planning legislation. Through examination of relevant laws and administrative regulations and processes, combined with simulation exercises involving examination of actual procedures such as development applications and environmental assessments, students will become more conversant with the legal frameworks and processes of land management.

Learning Outcomes

Upon successful completion of this subject, students should:
Be able to:
* Relate fundamental principles of law to environmental management techniques.

* Implement environmental objectives through the use of statutory plans.

* Participate in the planning and environmental administration process.

* Distinguish between the different roles of administrators, lawyers and the Courts in resolving environmental disputes.

Syllabus

The subject will cover the following topics:
The subject consists of three modules: Module 1: Introduction to basic legal concepts: The history of law in Australia, the court system, property law, torts, the sources of environmental law in Australia, environmental law concepts, the international influence. Module 2: Environmental planning: The planning process, planning legislation, Environmental Planning and Assessment Act 1979 (NSW), development assessment, other provisions of the legislation, the consent process, legal challenges to decision making. Module 3: Environmental protection and conservation: Legal controls on land use and management, the role of different levels of government in environmental protection, land protection, pollution control, water resources, air quality.
