The subject is designed to allow students to learn and apply laws relating to the individual employment relationship. In addition, students will examine and apply the law pertaining to discrimination through scenario based learning and investigate the law that applies to occupational health and safety issues.

Learning Outcomes

Upon successful completion of this subject, students should:
  • be able to explain the law relating to contracts of employment;
  • be able to identify instances of discrimination and breaches of workplace health and safety, and explain the law relating to them;
  • be able to apply the law covered in this subject to workplace scenarios;
  • be able to analyse the law in relation to workplace scenarios; and
  • be able to effectively communicate the application of the law to workplace scenarios.

Syllabus

This subject will cover the following topics:
  • employer/employee relationship;
  • other relationships;
  • contract of employment;
  • implied duties of employers and employees;
  • contract of service performance;
  • contract of employment termination - dismissal and reinstatement;
  • remedies - injunctions, declarations, damages;
  • discrimination legislation and its ramifications for employment with regard to the constitution and other legislation;
  • occupational Health and Safety legislation and its relevance to labour law.
